Vently Terms of Service

1 Agreement

These Terms of Service ("Terms") are an agreement between you and BynarTek ("we", "us" or "our") for your use of the Vently app ("Vently" or "the app"). By downloading or using Vently, you agree to these Terms. If you do not agree, please do not use the app. The rules of the store you downloaded it from (Google Play or the App Store) also apply.

2 The App and Your Licence

Vently is an entertainment app for letting off steam: your scream, expression or breath drives playful animated scenes. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Vently on devices you own or control, for your own non-commercial enjoyment.

3 Not Medical Advice

If you are struggling, please talk to someone you trust or a health professional. If you are in crisis or in danger, contact your local emergency services right away (in Vietnam, call 115).

4 Use Vently Safely

• Mind your voice. Screaming can strain your throat. Stop if it hurts, and try the silent scream (your face alone) instead.
• Mind your surroundings. Be considerate of people nearby, and don't play where a sudden scream could startle or endanger anyone.
• Mind the volume. Keep headphone volume at a comfortable level.
• Never use the app while driving, cycling or doing anything that needs your full attention.
• Some scenes contain flashing lights (such as fireworks and lightning). If you are sensitive to flashing images, play with care or not at all.

You use the app at your own risk and are responsible for using it safely.

5 Camera, Microphone and Privacy

Vently uses your camera and microphone only on your device, in real time, and never records or sends them anywhere. See the Vently Privacy Policy for details. It forms part of these Terms.

6 Advertising

Vently is free and supported by ads from third parties (Google AdMob). We do not control the content of third-party ads or the sites they lead to, and we are not responsible for them. Any dealings you have with advertisers are between you and them.

7 Intellectual Property

Vently™, its name, logo, artwork, scenes, sounds and software are owned by BynarTek and protected by intellectual property laws. These Terms do not give you any rights to them except the licence in section 2. Vently includes open-source software, which is provided under its own licences, listed in the app under Settings → About → Open-source licenses.

8 What You May Not Do

• Copy, modify, distribute, sell or rent the app or any part of it.
• Reverse engineer or decompile the app, except where the law allows it.
• Remove or change any copyright, trademark or other notices.
• Use the app for any unlawful purpose, or to harass or frighten others.
• Interfere with the app's ads, for example by generating fake ad views or clicks.

9 Disclaimer

Vently is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including that the app will be uninterrupted, error-free or suitable for a particular purpose. How the app reacts depends on your device, camera, microphone and surroundings, and may vary.

10 Limitation of Liability

To the fullest extent permitted by law, BynarTek is not liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the app. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

11 Changes and Termination

We may update the app, add or remove features, or stop offering it. We may also update these Terms; we will change the "Last Updated" date above and, for significant changes, let you know in the app. You may stop using Vently at any time by uninstalling it. Your licence ends automatically if you break these Terms.

12 Governing Law

These Terms are governed by the laws of Vietnam. Any dispute will first be resolved through good-faith discussion; failing that, it will be brought before the competent courts in Ho Chi Minh City, without affecting any mandatory consumer protections in your country of residence.
